Janeanne Lubin-Szafranski has substantial experience in the areas of healthcare regulation, and complex transactions, captive insurance companies, enterprise risk management, contract negotiation and management, regulatory compliance, and joint ventures. Serving as former General Counsel to complex healthcare systems in Connecticut, Janeanne has experience leading large-scale organizational transition and directing enterprise-level legal, operational, compliance and risk management strategies. She is a creative and strategic leader with a reputation for high integrity. She builds strong relationships with board members, executive team members, employees, and physicians, as well as industry and community leaders.
Janeanne’s practice is broad and encompasses many different legal areas within the healthcare space. Janeanne has particular experience with respect to the following types of matters: hospital, physician and payer affiliations, including negotiations of affiliation agreements, revisions to governance documents, regulatory approvals, and diligence matters; the formation and operation of accountable care organizations (ACOs), physician-hospital organizations (PHOs), independent practice associations (IPAs), and related multi-provider networks; compliance with the federal anti-kickback statute, Stark law, and other fraud and abuse laws in the context of safe harbor arrangements, relationships with physicians, and complex health care transactions; bioethics, HIPAA, HITECH, and state privacy laws, including the development of comprehensive privacy and security policies and related guidance documents; employment matters focused on physician contracts, employment policies and procedures, and regulatory compliance.
Within the healthcare industry Janeanne transformed a complex professional and general liability litigation system by creating two single-cell captive insurance companies. These companies covered over 150 community physicians, 250 employed physicians, and all healthcare system entities. She produced premium savings in excess of $100M and achieved an experience ratio of .625%, significantly reducing risk on an enterprise-wide basis. Managing a case load of over 200 open matters, she settled numerous claims significantly below indemnity and expense reserve limits. She obtained executive management buy-in and implemented centralized, comprehensive contract approval including, tracking and implementation of an administration process which provided the framework for the successful management of more than 3,000 active contracts. Janeanne has represented major healthcare systems in numerous mergers, acquisitions, and the creation of new structures to meet the ever-changing challenges experienced by her clients.
Attorney Lubin-Szafranski is admitted to practice in Connecticut and she received her BA, magna cum laude in political science and economics from Boston College and earned her JD, magna cum laude from the University of Connecticut School of Law.
